What is the value of a human life? What is the value of a healthy life versus a life with disability? What underlies the Court’s rationale when deciding cases about wrongful birth and wrongful life? The answers to these questions are not clear. Some Courts have conceded that it is really public policy behind its decision, while others would deny any public policy influence stating that the decision is firmly founded in law. We will explore this question in the context of reviewing the latest developments in the law related to both wrongful birth and wrongful life claims.
