Daniel is a leading practitioner in the areas of defamation, privacy and media law.

Biography

Daniel maintains a robust practice focused on defamation and privacy law, with a particular focus on online defamation and breaches of privacy. In addition, Daniel practices in insurance and professional negligence cases.

Dan has more than fifteen years of experience advising clients and serves as co-chair of our privacy and data protection group. In this area of practice, Daniel has acted in high profile defamation and privacy cases, advised professionals and corporations dealing with privacy breaches, and frequently teaches professional development courses for lawyers and industry professionals relating to electronic evidence.

Daniel is cited by the Supreme Court of Canada (in conjunction with Mr. Baynham, KC) in the leading case concerning liability attached to “hyperlinks”. Daniel is a sought-after speaker on legal/technological issues, including issues relating to online publications on Facebook and X (formerly Twitter) and anonymous emails, and has appeared on many local and national news programs, including CTV National News, CBC National News, and CKNW radio.

Daniel has also published numerous legal articles on the intersection of technology and law, including articles on the sharing-economy, the impact of “gig workers” on the insurance industry, and legal tools for proceeding against “anonymous” individuals.

Daniel grew up in Calgary and attended Carleton University in Ottawa to pursue a journalism degree. After working in radio and television, he moved to Vancouver to attend law school in 2005. He articled with Harper Grey and following his call to the Bar of British Columbia in 2009, he joined the firm as an Associate.

Defamation and Privacy Law

Daniel has acted as counsel in cases concerning allegations of libel by the media, online defamation, cyber-bullying, and invasion of privacy.  He has successfully obtained orders preventing publication of defamatory material, requiring production and forensic analysis of computer hard drives, payment of special costs in respect of improper document collection, and orders for disclosure of anonymous online authors.  Below is a sample of defamation and privacy law cases in which Daniel has acted as counsel:
