Salman is a Partner with Harper Grey. With over 25 years’ experience, Salman has established a business dispute resolution practice with a focus on real estate, corporate and commercial litigation, and insolvency.

Biography

Salman is chair of our Real Estate Group and co-chair of our Insolvency and Restructuring Group.

Salman’s clients range from individuals and small businesses to multinational corporations and large financial institutions. He is also panel counsel for chartered banks and trust companies. His focus is both on advising clients on risk management strategies and on negotiation of effective resolution to complex business disputes. He frequently represents clients involved in cross-border commercial disputes. Salman’s practice covers an extensive range of matters and many dispute-resolution forums. He has represented clients in mediations, arbitrations, and has appeared before all levels of court in British Columbia.

Salman has received recognition as a leader in his areas of practice by Benchmark Canada, Best Lawyers, and Lexpert.

Salman is active within the legal profession and the community. He is part of our mentorship program and serves as a board member for the BC Ismaili Conciliation and Arbitration Board. He also volunteers his time with the UBC’s Law Students Legal Advice Program and FOCUS Humanitarian Assistance.

Commercial Litigation
  • Represents clients in business disputes including contractual, shareholder and oppression remedies

  • Represents clients in cross-border jurisdictional disputes before the Supreme Court of British Columbia

  • Represented a publicly-traded company in an intellectual property dispute over rights to a trade name

  • Represents commercial landlords and tenants in lease default actions

  • Represents directors and officers in claims brought against corporations by creditors

  • Represents clients based in the U.S. to enforce a Letters Rogatory Order in British Columbia

  • Acting for a shareholder in an oppression proceeding involving large real estate holdings

  • Representing a former partner in a dispute involving a number of inter-related businesses including claims of breach of contract, breach of trust and unjust enrichment

Insolvency & Restructuring
  • Represents banks, trust companies and other financial institutions in financial restructuring and security enforcement proceedings

  • Represents creditors in corporate restructuring proceedings

  • Represents clients in commercial foreclosure proceedings

  • Advises clients on creditor priority disputes

  • Advises trust companies and lenders on receivership matters including inter-jurisdictional matters

  • Advises clients on issues relating to distressed property sales

  • Represents financial institutions in a series of claims including allegations of negligence, an order for rescission, tort of deceit, allegations of fraud and breach of fiduciary duty

  • Acting for a liquidating trust in a cross-border matter related to Chapter 11 Bankruptcy in the U.S.

Real Estate
  • Advises clients including investors, banks and REITs concerning risk management in relation to the purchase and sale of commercial property and with their real estate portfolios

  • Provides litigation and alternate dispute resolution services in relation to complex real estate disputes for commercial real estate owners and investors including the following:

    • contractual disputes involving land claims
    • commercial real estate contract disputes
    • commercial mortgage disputes
    • disputes involving large real estate developments and multi-family buildings
    • corporate litigation involving real estate holdings
    • property ownership rights disputes
    • purchase and sale disputes
    • title disputes
    • floor space ratio (FSR) disputes, and
    • financing and leasing disputes relating to commercial and residential real estate
  • Advises clients on agricultural lands and dealing with the Farm Debt Mediation Board

  • Represents real estate brokerages in financing disputes

  • Advises clients in relation to option agreements relating to land

  • Represents commercial landlords and tenants in lease default actions

  • Represents banks and commercial real estate owners in a range of matters including lending litigation and security enforcement

  • Represents insurance brokerage firms in contractual disputes relating to insurance policies

  • Defends clients in proceedings brought under the Financial Institutions Act before the Insurance Council of British Columbia
