Rose Keith, KC quoted in HR Reporter article on how to use NDAs

Harper Grey partner, Rose Keith, KC, was recently quoted in HR Reporter’s article titled “How to use NDAs without getting burned.” The article, published on January 21, 2026, discussed the issues the Vancouver Symphony Orchestra (VSO) ran into while threatening legal action against a violinist who broke non-disclosure agreement (NDA) by talking about an alleged sexual assault. The article gave practical tips on confidentiality agreements between employers and employees.
The article notes that “NDAs can hide patterns of misconduct and enable serial perpetrators to continue offending in new workplaces.” Rose Keith commented that “if it makes the news that could create a real problem for employers.” She remarks “in an employment context, there’s often regulatory overlay. If you’re the victim of sexual harassment, that falls within the purview of WorkSafe BC. So, to enter into an NDA that prohibits you from making a regulatory complaint would be improper and would be frowned upon — just like entering into an NDA that prevented you from being able to report a crime.”
